Agreement and legal limits
By accessing or using Kirzen, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use Kirzen. Nothing in these Terms is intended to exclude rights or protections that cannot lawfully be waived under the laws applicable to you.
Service
Kirzen is a third-party Discord application providing moderation, utility, automation, configuration, custom embeds, server management and dashboard features. Features, limits, interfaces and availability may change as the product evolves.
Kirzen is not operated by Discord. Discord and its trademarks remain the property of their respective owner, and use of Kirzen is also subject to Discord's applicable terms and policies.
Eligibility and authority
- You must comply with Discord's age and account requirements and any stricter requirement imposed by applicable law.
- You must have authority to install or configure Kirzen in a Discord server.
- You are responsible for ensuring that your use of Kirzen is lawful in your jurisdiction.
- Do not use another person's account or authorization without permission.
Acceptable use
You may not use Kirzen to:
- facilitate illegal activity, fraud, phishing, credential theft or malicious activity;
- harass, threaten, stalk, exploit or abuse other people;
- infringe copyrights, trademarks, privacy or other rights;
- distribute malware, destructive code or content designed to compromise systems;
- evade rate limits, access controls, security measures or other technical restrictions;
- collect, expose or process personal information without an appropriate lawful basis or authority;
- misuse moderation, logging or automation features to cause unlawful harm;
- impersonate Kirzen, Discord or another person or organization; or
- use the service to violate Discord's Terms of Service or other applicable platform rules.
Lawful criticism, opinions, reviews and good-faith reports about Kirzen are permitted. This section does not prohibit exercising legal rights; it prohibits unlawful abuse, threats, fraud and other prohibited conduct.
Server administrator responsibilities
If you configure Kirzen for a server, you are responsible for choosing appropriate features, channels, permissions and retention practices. You must provide any notices required to members whose data may be processed and ensure that your use of logging, moderation, greetings, warnings and related features has an appropriate legal basis.
You must not use public Discover fields to publish personal, confidential or sensitive information that you are not authorized to disclose.
User content and Discover
You retain ownership of content you submit to Kirzen, subject to rights held by third parties. You grant Kirzen a limited, non-exclusive, worldwide, royalty-free right to host, transmit, store, reproduce and display that content only as reasonably necessary to provide, secure and improve the feature you requested.
For public Discover listings, this license also covers displaying the listing to other users. You are responsible for having the rights and permissions required for any content you publish. Do not submit content you do not have the right to process or disclose.
Privacy and data protection
Personal data is handled according to the Privacy Policy. Depending on the feature and jurisdiction, Kirzen may act as a controller, processor or service provider, while a Discord server administrator may determine the purposes of processing member data. Discord may independently process information under Discord's own privacy terms.
Do not use Kirzen to store passwords, payment credentials, government identity numbers or other unnecessary highly sensitive information. Requests to access, correct or delete data can be made through the privacy contact listed in the Privacy Policy.
Third-party services and Discord
Kirzen depends on Discord and may depend on hosting, infrastructure and other third-party services. Third-party services are governed by their own terms, availability and policies. An outage, API change, permission change or limitation imposed by a third party may affect Kirzen.
Availability and changes
Kirzen is provided on an evolving basis. We may add, remove, suspend or modify features, commands, limits, integrations or interfaces. We may temporarily suspend access for maintenance, security, abuse prevention or legal reasons.
We do not promise uninterrupted availability, error-free operation or that every feature will remain available indefinitely. We will make reasonable efforts to keep the service operational and to address material security or service issues when practical.
Suspension and termination
Kirzen may suspend or terminate access to Kirzen when reasonably necessary to address violations of these Terms, Discord rules, security threats, fraud, abuse, legal obligations or risks to users and the service. Where appropriate and feasible, we may provide notice or an opportunity to correct the issue.
You may stop using Kirzen at any time. Removing the bot from a server does not automatically guarantee immediate deletion of every record; data retention and deletion are governed by the Privacy Policy and applicable law.
Intellectual property
Kirzen, including its software, branding, interface, original designs, documentation and proprietary materials, is owned by or licensed to Kirzen. Except where expressly permitted by law or written authorization, you may not copy, resell, redistribute, reverse engineer, rebrand or commercially exploit proprietary parts of Kirzen.
These Terms do not transfer ownership of your content to Kirzen and do not transfer ownership of third-party materials to either party.
Disclaimers
To the maximum extent permitted by applicable law, Kirzen is provided on an "as is" and "as available" basis. We disclaim warranties that the service will be uninterrupted, completely secure, error-free, or suitable for every particular purpose, except where such exclusions are not permitted by law.
Kirzen is an administrative tool, not a substitute for professional legal, security, compliance or emergency services. You remain responsible for decisions made using the service.
Limitation of liability
To the fullest extent permitted by applicable law, Kirzen will not be liable for indirect, incidental, special, consequential or punitive damages, or for losses caused by third-party platforms, unauthorized access outside our reasonable control, user configuration, content submitted by users, or service interruptions.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer or data-protection rights where applicable. Nothing in these Terms limits liability for fraud or other liability that the applicable law does not permit us to limit.
Indemnity
To the extent permitted by applicable law, you agree to be responsible for claims arising from your unlawful use of Kirzen, your violation of these Terms, or your infringement of another person's rights. This provision does not shift responsibilities that applicable law places on Kirzen and does not limit mandatory consumer protections.
Governing law and mandatory rights
These Terms are governed by the laws of Brazil, without prejudice to mandatory consumer, privacy or other protections that may apply in the country or jurisdiction where you live. Where local law gives you a mandatory right that conflicts with a provision of these Terms, that mandatory right prevails to the extent of the conflict.
Changes to the Terms
We may revise these Terms when the service, law or business practices change. The current version will be published in the dashboard with an updated effective date. Where applicable law requires additional notice or consent for material changes, we will follow that requirement.
